Firms Who Employ Illegal Immigrants Sued
By PETER PRENGAMAN

LOS ANGELES — Frustrated by lax enforcement of immigration law, businesses are taking their fight against illegal immigration to court, accusing competitors of hiring illegal workers to attain an unfair advantage.

Businesses and anti-illegal immigration groups stated the legal action was an attempt to develop an economic deterrent against hiring illegal personnel.

“We see the legal profession bringing to this issue the type of impact it is had on consumer product safety,” stated Mike Hethmon of the Immigration Reform Law Institute, a Washington D.C.-based group backing the efforts.

In the 1st of a series of lawsuits, a temporary employment agency that supplies farm workers sued a grower and a two competing businesses on Monday.

Similar circumstances claiming violations of federal anti-racketeering laws have yielded mixed results. The California lawsuit is believed to be the very first based on a state’s unfair-competitors laws, legal experts stated.

Santa Monica-based International Horizons claimed in the lawsuit that Munger Brothers, a grower, hired illegal immigrant workers from Ayala Agricultural Services and J&A Contractors. All the defendants are based in California’s farm-rich Central Valley.

The suit alleges that Munger Brothers had a contract with International Horizons to provide much more than 600 blueberry pickers this spring, but nixed the agreement so it could employ illegal immigrants.

“Competitors hiring illegal immigrants is hurting our organization badly,” Global Horizons President Mordechai Orian said. “It really is to the point that carrying out company legally is not worth it.”

Ayala Agricultural Services manager Javier Rodriguez had not observed the suit but said the business does not employ undocumented immigrants.

“If someone does not have a green card or operate documents, we do not employ them,” he mentioned.

Munger Brothers lawyer Theodore Hoppe said the contract with Global Horizons fell apart because the laborers they supplied couldn’t choose blueberries at the rate the firm had promised. He said Munger Brothers hired workers via temporary agencies, which had the responsibility to employ legal workers.

J&A Contractors did not quickly return calls in search of comment.

With an estimated 11 million illegal immigrants in the United States, undocumented workers are a huge part of the nation’s perform force.

But immigration law enforcement at perform internet sites is restricted. In fiscal year 1999, authorities arrested two,849 folks at perform websites compared with 1,145 arrests final year, according to the federal Immigration and Customs Enforcement agency.

To prove competitors employ illegal immigrants, organizations could use public records involving prior violations, testimony from former personnel who have worked alongside illegal immigrants, and recovered W-two tax forms that show folks working beneath fake names and Social Security numbers, stated David Klehm, the lead lawyer for situations in Southern California.

Firms arranging to file additional lawsuits include farms and factories that depend heavily on immigrant labor, Klehm mentioned.

Legal specialists mentioned the circumstances could be tough to win. Below the California statutes, plaintiffs should prove a competitor directly harmed their company.

“Unless you have got smoking gun evidence, it’s challenging to tie economic loss of a single company to another’s practices,” mentioned Niels Frenzen, a law professor at the University of Southern California.

He believes it is the 1st time the unfair-competition law has been utilised to target illegal immigration.

The Global Horizons lawsuit came following a settlement was reached in a Washington state class action suit involving personnel of Zirkle Fruit Co. who sued their employer for driving down wages by hiring undocumented workers.

Based on federal anti-racketeering laws, the case was settled for $ 1.three million in January immediately after the 9th U.S. Circuit Court of Appeals overturned a lower court choice to dismiss it.

Howard Foster, the lead plaintiffs’ lawyer in the Washington case, mentioned he expects a lot more such suits as business owners discover their competitors hired illegal immigrants.

“So several folks speak openly about employing false documents to assemble an illegal workforce,” Foster stated. “And when you have IDs with upside down numbers and backward photographs, you know they are fake.”

Question by freakonomics: Is “Entrepreneur” just a prettier name for “sales individual”?
I know a lot of entrepreneurs and they sell extremely well. I don’t know entrepreneurs who can’t sell. Is the noun “entrepreneur” designed just to make it sound much better than a “sales individual”?
Thanks for quick replies.

Some mentioned entrepreneurs take their own risks. I assume sales take risks too — their compensation is normally solely based on how nicely they sell. They are risking their time and reputation.

An additional reason why I’m asking is that when economic institutions appear for folks to sell their goods, they usually advertise as:

Be your own boss, manage your own company, take manage of your future, turn out to be an entrepreneur!

So, it seems entrepreneur = sales.

Question by Starfire: Just by reading this story what do you assume the moral of it is?
A young girl only the age of sixteen sat cross legged on her twin bed in her dim lit space. You could hear moans and groans escape from her chapped lips as she flipped the pages of her book with displeasure. It was assigned to her by her contemporary literature teacher, Mr. Draken. She had nothing against him what so ever. It was the book that bothered her. Certain it began out gratifying with all the colorful and peaceful descriptions, but that did not last. Further on in the book the story became dull and depressing. Some of the newer chapters even had complicated words such as entrepreneur. “What the hell does that even mean?” She wondered. She couldn’t take it anymore She wanted the story to finish! Even although she required this grade, making her read this irrational novel was too a lot to ask for. The girl skimmed by way of the back of her mind searching for a way to remove the novel. She believed of ripping out the pages, tossing it in the garbage, and even throwing it into a murky lake. She came to the conclusion that she was going to burn it. Even although this action could lead to her paying for the novel she would harm, it actually didn’t matter to her. She just did not want the finnish that story. As she was about to throw the novel into the fire place she looked up at the picture on the wall. It was of her father. She knew that he would be disappointed that his own daughter would end up failing a class all since she did not want to read a book. She smiled at the picture and returned to her space to continue on with her story.

Note: This does not need to have criticism. All I’m asking is that if you can guess what the moral of this story is.
